Which permitted development rights do I have in a National Park?ย 

 

I am asked this on a regular basis ‘Do permitted development apply in a National Park?’ Many people assume that just because their property is in a National Park they do not have permitted development rights. This is not true!

Yes, there are restrictions – but it certainly doesn’t mean that you do not have them. See also PD rights in an AONB & PD rights in a conservation area & PD rights on a listed building.

National Parks include Dartmoor, Exmoor, Lake District, New Forest, North York Moors, Northumberland, Peak District, South Downs and Yorkshire Dales. Within the GPDO these are classified as Article 2(3) and Article 2(4) land. The difference being that Article 2(4) land also includes some areas outside of the National Park. The Norfolk and Suffolk Broads are not strictly a National Park, and they are listed separately from other National Parks in certain circumstances. This page will include PD rights in The Norfolk and Suffolk Broads, but where it varies we will list them below. In the vast majority of the GPDO they are identical to the National Parks as far as PD rights are concerned.

Everything listed below is Article 2(3) unless identified, therefore the additional areas mentioned in Article 2(4) land, have full PD rights, unless restricted by another designation etc.

What can I do with my house in a National Park??

 

Before you start altering your dwelling, check to see if an Article 4 exists in your area. Occasionally one might exist to restrict certain items that might affect the characteristics of a National Park. Sometimes this might only impact the front elevation. Don’t assume that an Article 4 will prevent works on the entire property. Search ‘<local authority name> Article 4’.

You might also have planning restrictions via a previous planning application or when the property was new, especially if built in the last decade or so.

Other matters

 

Demolition of buildings of less than 50 cubic metres that are not a statue, monument or memorial should not be development and should not require planning permission to demolish unless also a listed building requiring listed building consent. However if in doubt check

Note that all the rights above may not apply to listed buildings within a conservation area or where land is designated as AONB or another designation. They may also be restricted by an Article 4 or previous planning decision.
